1. Payment Terms

  • The payment conditions outlined here ("Payment Terms") apply to any payments made or received through the website www.MNHuna.com, which is run by MNHUNA LLC.
  • MNHUNA LLC., referred to in these Payment Terms as "Huna," "we," or "us," manages card transactions both within and outside the U.S.
  • Before you make or receive payments on the Site, please go through these Payment Terms carefully. By using the Site for payments, you are giving your consent and agreeing to these Payment Terms, whether for yourself, your company, or any other entity you represent. These Payment Terms are an addition to the General Terms of Service provided by MNHuna (together referred to as the "Terms of Service").

2. Receiving Payments

2.1 General

  • When you complete a sale of a service, your account is credited with an amount equal to 80% of the purchase price.
  • Huna credits Sellers when an order is marked as completed.
  • Should an order be canceled for any reason, the funds will revert to the Buyer's mnhuna Balance.
  • Sellers are responsible for any taxes that apply to them, whether direct or indirect taxes like GST, VAT, or income tax, based on their residence or location as per their local laws. Sellers confirm that they meet, and will continue to meet, the requirements of their local income tax laws. The price displayed on the service page includes any such taxes and charges that might apply to the Sellers.
  • The Seller authorizes mnhuna to act as their limited agent solely for the purpose of collecting payments from the Buyer, and for forwarding those payments to the Seller. Payment to mnhuna by the Buyer is considered the same as a payment made directly to the Seller. The Buyer's payment responsibility is fulfilled when mnhuna receives the payment, and it is then mnhuna's responsibility to pass the payment on to the Seller as laid out in these Payment Terms. If mnhuna fails to forward the funds to the Seller, the Seller's recourse is only against mnhuna, not the Buyer.
  • Huna works with Payment Services Providers to handle the collection of payments from Buyers, the disbursement of these payments to Sellers, and to manage mnhuna Balances. Withdrawal of funds on the mnhuna platform is conducted by mnhuna's Payment Services Providers.

2.2 Withdrawing Revenues

  • To access your earnings, you need an account with one of mnhuna's Payment Service Providers as outlined in our withdrawal methods. Your eligible funds will be held in an account by mnhuna’s Payment Service Provider, who also provides all payment services, including withdrawals.
  • You can link only one account per withdrawal method to your mnhuna profile, and each Payment Service Provider account can only be linked to one mnhuna profile.
  • After a safety clearance period of 10 days post-order completion, your revenues become available for withdrawal on the Revenue page. For Top Rated Sellers, this period can be reduced by up to 7 days.
  • To withdraw your available earnings, select your preferred withdrawal method on mnhuna and follow the prompts to start the withdrawal process.
  • For the sake of security, we may need to temporarily disable a Seller’s withdrawal capability to prevent fraudulent or illicit activities. This could be due to security flags, reports of misconduct from other users, or if multiple mnhuna accounts are linked to a single withdrawal method.
  • Withdrawals must match the available balance in your account.
  • Each withdrawal method may involve different fees.
  • Once initiated, withdrawals cannot be reversed or canceled.
  • Sellers may choose to withdraw funds in various currencies. mnhuna’s Payment Services Providers handle any currency conversions, which will reflect the US dollar value of your mnhuna Balance and are subject to daily exchange rate changes and conversion fees. You can also opt to withdraw in US dollars.
  • Revenues from disabled accounts can be withdrawn after a 90-day safety period, pending account ownership verification and the date of the last payment clearance, all subject to mnhuna’s approval.

2.3 Withdrawal Methods

  • Withdrawals from mnhuna to any selected payment method will take 3-5 business days to be processed. (varies depending on the withdrawal method)
    • Additional fees may apply based on your location and currency.
    • Additional time may be required based on your location and currency.

3. Purchasing

3.1 General

  • Buyers should make payments directly to mnhuna to initiate an order from a Seller’s Services page, using either the Order Now button. mnhuna collaborates with Payment Services Providers to manage all payments from Buyers, distribute these payments to Sellers, and oversee mnhuna Balances. All payment processing on the mnhuna platform is handled by these providers.
  • Acting as the Seller’s limited agent, mnhuna is authorized solely to accept payments from Buyers and pass them on to the Seller. A Buyer’s payment duty is met when mnhuna acknowledges the payment, after which mnhuna is accountable for ensuring the Seller receives this payment according to these terms. Should mnhuna fail to pass on payments, Sellers should seek resolution from mnhuna, not the Buyer.
  • Typically, Buyers can pay on mnhuna using Credit Card, PayPal, mnhuna Credits, or a mnhuna Balance, with additional methods available in some locations. Further details on payment methods are accessible on the site.
  • At checkout, service fees are added for review and confirmation by the Buyer. These fees, which as of April 2024 stand at 10% of the purchase amount. Purchases below $30 incur a fixed fee of $3 instead.
  • Any existing mnhuna Balance will automatically be deducted from your subsequent purchase.
  • Buyers must not circumvent the platform by offering to pay outside of the mnhuna.com site or agree to such proposals. Any alternative payment suggestions should be reported to Customer Support immediately.
  • Buyers agree to accept electronic invoices and payment receipts from mnhuna, delivered either via email or through the Site.
  • To safeguard against fraudulent or illegal activities, payment details related to withdrawals are collected by mnhuna or its Payment Services Providers, who may gather additional information as necessary to process these payments. mnhuna does not access payment data provided to Payment Services Providers, which is governed by the providers' privacy policies.   • When providing payment details on mnhuna, you affirm that you are legally permitted to provide such information, authorized to make payments with the payment method, and if acting on behalf of another entity, that you are authorized by them to make the payment, and that these actions comply with the law.

3.2 Local Currencies

  • Huna allows payments in various currencies for your convenience. Prices may be rounded up to the nearest number, but the exact amount due will be shown at checkout. Unless indicated otherwise, you'll be charged in the currency shown on the payment page. Currency conversion for local currency payments is handled by mnhuna's Payment Services Providers. Sometimes, if a payment method doesn't support a particular currency, you'll be charged in US dollars, even if another currency is displayed. The final charge amount in the payment currency will always be disclosed before you finalize the payment.
  • Remember, all mnhuna prices originate from a base US dollar amount. Non-US dollar prices can fluctuate daily based on exchange rates and may include conversion fees. You can always opt to pay in US dollars if you prefer.
  • If you make a payment in a currency other than US dollars and your order is canceled, the refunded amount in your mnhuna Balance will reflect the exchange rate at the time of cancellation. This means the refunded amount in local currency may differ from what you originally paid, though the US dollar value remains the same.
  • Your mnhuna Balance is primarily held in US dollars, even if displayed in another currency. If you choose to see your balance in a different currency, the amount may change with the exchange rate, but the US dollar value stays consistent. You can view your mnhuna Balance in US dollars at any time by changing your display settings.

3.3 Huna Credits

  • Sometimes, mnhuna might give you mnhuna Credits to use on the site for buying Gigs and other services. These Credits will show up in your account, and they'll be automatically used on your next purchase. You'll see them in your order summary. Unless we say otherwise, Credits expire after three months. They're meant to encourage you to enjoy more of what mnhuna offers and can't be exchanged for cash—they're not refundable and don't have a cash value. If you cancel an order, any Credits used won't go back into your account. When you get Credits, we'll let you know if there are any extra rules or limits. If someone misuses Credits or breaks the terms, we might cancel them. We can also change or stop the Credits program whenever we need to. If your account is closed for any reason, any Credits you haven't used will be gone.

3.4 Promo Codes

  • Huna occasionally provides promo codes for discounted purchases of Gigs and other site services. These codes are only good for mnhuna purchases and come with an expiration date. To use a promo code, enter it on the checkout page; if you don't, the discount won't apply. Promo codes are a one-time deal per user and can't be mixed with other offers. If your order has multiple parts (milestones), the promo code applies just to the first one. These codes won't work with mnhuna Credits. Any additional rules or restrictions will be shared when you get a promo code. Misuse or breaking the Terms of Service could make promo codes invalid. Also, mnhuna has the right to change or stop promo codes at any time.

4. Taxes

  • Depending on the law, mnhuna might have to add indirect taxes (like Sales Tax, VAT, or GST) to user charges or withhold taxes. Any taxes mnhuna needs to collect will be on top of what buyers already pay, and anything we have to withhold will come out of the seller's earnings.
  • These indirect taxes are extra and not included in the site's listed prices, but they'll be clearly shown to buyers before they pay.
  • It's up to users to handle any taxes, whether they're direct or indirect like GST, VAT, or income tax, based on where they live and other legal requirements.

5. Disputes and Cancellations

We urge buyers and sellers to work out any disagreements on their own. If you can't resolve an issue through the Resolution Center, or if you come across behavior that's not allowed on the site, you're welcome to reach out to mnhuna's Customer Support team for help.

5.1 General

  • Orders can be canceled on mnhuna, subject to eligibility, either by mnhuna directly (through Customer Support or other means) or via the Resolution Center on a per-order basis.
  • Initiating a chargeback or dispute with your bank or payment provider before utilizing the Resolution Center for assistance contravenes these Payment Terms. Disputes must first go through the Resolution Center before involving your payment provider. Ignoring this procedure could lead to temporary or permanent suspension of your account. Note that once a dispute is raised with your payment provider, the funds cannot be refunded by us due to our commitment to the payment provider.
  • If there's an issue with the service in your order, we encourage you to use the site's dispute resolution tools to try and settle the problem.
  • Huna, alongside its Payment Services Provider, holds the right to cancel orders or freeze funds if there’s suspicion of fraudulent activity on the Site.
  • The transfer of intellectual property rights to the buyer hinges on complete payment. The delivered work cannot be used if the payment is revoked for any reason.
  • Should an order be canceled for any reason, the paid funds will revert to the buyer's mnhuna Balance.
  • Sellers have the discretion to offer revisions to their deliveries based on their Gig terms and customer service policies, including offering no revisions.
  • Revision requests should be made through the Order Page once the order is marked as Delivered.
  • It is prohibited to use the Request Revisions button to seek additional services from Sellers beyond the initially agreed requirements.

5.2 Order Cancellations

  • Huna advises Buyers and Sellers to address and settle any disputes regarding services through the Resolution Center.
  • The decision for mnhuna to cancel an order takes into account several factors, such as breaches of our Terms of Service, our Community Standards, misconduct, or misuse of mnhuna’s delivery system. Criteria for order-specific eligibility are outlined below.
  • Orders, or where relevant, milestones, can be canceled upon the Customer Support team's review up to 10 days after they are marked as complete. Note that orders can only be canceled in full, meaning partial cancellations are not possible.
  • Under exceptional circumstances, our Customer Support may decide to cancel a completed order even after the 10-day period. In these instances, the payment made for the canceled order will revert to the Buyer’s mnhuna Balance and be deducted from the Seller’s mnhuna Balance. If the Seller’s mnhuna Balance does not cover the amount, it will be taken from future earnings.
  • Orders cannot be canceled based on the quality of the service/materials if the delivered service aligns with the description on the Gig Page. However, you are encouraged to share your service experience with the Seller on the Order Page.
  • Concerns and resolutions regarding the service provided must first go through the mnhuna Resolution Center before seeking help from Customer Support. Customer Support will not intervene in orders where Buyers have not informed Sellers of service-related issues, giving Sellers the opportunity to resolve the matter first. This does not apply to unauthorized use of mnhuna.
  • Any unauthorized use of mnhuna identified during an Order, after review by our Customer Support, may lead to the order’s cancellation. This encompasses actions like harassment, illegal activities, or other breaches of mnhuna’s Terms of Service.
  • Orders might be canceled by mnhuna for reasons including, but not limited to, the below criteria:

Active Orders (after requirements were submitted to the Seller and before the Seller delivers on mnhuna)

  • If the Seller has not responded and the order has been marked as Late for over 24 hours.
  • If either user behaves abusively, including threats of poor ratings or using the order materials (like login details, personal information) to threaten or coerce the other party.
  • If any user provides or incorporates materials that infringe on copyright or trademark laws within their order requirements or in what the Seller delivers.
  • If a user's account has been closed or they are no longer active on mnhuna due to violating the Terms of Service.

Delivered Orders (after the Seller clicks Deliver Now and before the order is marked as complete)

  • If the Seller misuses the Delivery system to push back the delivery date without providing the completed service. Repeated offenses could lead to permanent account suspension.
  • If the Seller fails to deliver any files or proof of work that meets the requirements agreed upon. The Customer Support team will examine the subjective nature of the materials in question.
  • If the Seller asks for extra payments, either within or outside the mnhuna platform, by holding back the final delivery of services tied to the agreed requirements.
  • If users misuse the Request Revisions feature to request additional services from Sellers that were not part of the original agreement.
  • If users threaten to post negative reviews to obtain additional services from the Seller that were not included in the initial requirements.

Completed Orders (after the order is marked as complete and before the 10-day limitation)

  • If users are verified and proven to have used copyright or trademark infringing materials.
  • If users who haven't acquired commercial use rights are found to have used the materials for commercial purposes. The terms for Commercial use are specified on the Seller’s Gig page and cannot be applied retroactively after 10 days post-completion.
  • Huna Customer Support will evaluate instances where Order delivery manipulation has hindered users from effectively using our Resolution Center, leading to an order being prematurely marked as complete.

5.3 Chargebacks

  • Huna reviews cases of payment provider chargebacks and disputes on behalf of Sellers. Although results vary per case due to each chargeback reason, we work hard on resolving disputes in the Seller’s favor. If the chargeback case allows, mnhuna (or one of mnhuna’s Payment Services Providers) will return parts or full revenue back to Sellers, otherwise the chargeback amount will be borne by the Seller.

5.4 Refunds

  • Huna doesn't automatically return funds from canceled orders to your original payment method. Instead, these funds go to your mnhuna Balance, where they're set aside for your future purchases on the platform.
  • If you're looking to have funds moved from your mnhuna Balance back to your bank or credit account, you can request this through the billing section. The feasibility of the refund, including the method, amount, and currency, depends on several factors. To safeguard against fraudulent activities, the number of times you can request a refund back to your payment method is limited and such requests are subject to evaluation by our Customer Support. Note, processing such refunds might incur an additional fee.
  • Sellers have the option to issue partial refunds for specific orders. If a buyer agrees to a partial refund, that amount is then processed back to the buyer's original payment method automatically. If for any reason mnhuna cannot process this refund to the payment method, the agreed sum will instead be credited to the buyer's mnhuna Balance.

6. General Terms

6.1 Modifications

  • Huna reserves the right to update these Payment Terms periodically. Whenever such updates occur, a revised version of the terms will be posted on this webpage.
  • By continuing to use mnhuna after these Payment Terms have been modified, you are agreeing to comply with and be bound by the updated terms. mnhuna considers your continued use of the platform as your acceptance of these changes.

6.2 Disclaimer of Warranties

  • THE UTILIZATION OF THE SITE, ITS CONTENTS, AND ANY SERVICES OR ITEMS ACQUIRED THROUGH THE WEBSITE IS SOLELY AT YOUR DISCRETION AND RISK. THE SITE AND EVERYTHING OBTAINED THROUGH IT ARE PROVIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPLICIT OR IMPLIED. NEITHER MNHUNA NOR ANY AFFILIATES CONNECTED WITH MNHUNA GUARANTEE OR ASSERT THE COMPLETENESS, SECURITY, RELIABILITY, QUALITY, ACCURACY, OR AVAILABILITY OF THE SITE.
  • THIS DISCLAIMER DOES NOT DISREGARD ANY WARRANTIES THAT CANNOT BE DISCLAIMED OR LIMITED UNDER THE LAW APPLICABLE TO YOU.

6.3 Limitation on Liability

  • HUNA, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS WON'T BE LIABLE FOR ANY KIND OF DAMAGES ARISING FROM YOUR USE OF THE SITE, OR YOUR INABILITY TO USE IT, ANY LINKED WEBSITES, THE CONTENT ON THE SITE OR SUCH WEBSITES, OR ANY SERVICES OR ITEMS ACQUIRED THROUGH THE SITE OR SUCH WEBSITES. THIS INCLUDES DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES—LIKE PERSONAL INJURY, EMOTIONAL DISTRESS, LOSS OF REVENUE, PROFITS, BUSINESS, ANTICIPATED SAVINGS, USE, GOODWILL, OR DATA, REGARDLESS OF WHETHER IT’S DUE TO NEGLIGENCE, BREACH OF CONTRACT, OR ANY OTHER CAUSE, EVEN IF IT WAS PREDICTABLE.
  • BY ACTING AS THE LIMITED AUTHORIZED PAYMENT COLLECTION AGENT OF SELLERS, MNHUNA AND ITS AFFILIATES ARE NOT LIABLE FOR ANY ACTIONS OR LACK THEREOF BY SELLERS.
  • THIS STATEMENT DOESN'T OVERLOOK ANY LIABILITY THAT THE LAW INSISTS CANNOT BE EXCLUDED OR LIMITED.
